                               ORDINANCE NO. 10603
                
                
                 AN ORDINANCE CLOSING AND ABANDONING UNNAMED
                 STREETS LOCATED NORTHEAST FROM NORTH RUNYAN
                 DRIVE, SOUTHEAST OF RUNYAN DRIVE, MORE
                 PARTICULARLY DESCRIBED HEREIN, SUBJECT TO
                 CERTAIN CONDITIONS.
                
                
                                                    
                
                
       	    	 SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
       CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
       and abandoned unnamed streets located northeast from North Runyan 

       Drive, southeast of Runyan Drive, more particularly described
       herein, and as shown on plat attached hereto and made a part
       hereof by reference:
            Two unnamed 30 foot wide rights-of-way, the first
            beginning on the northeast line of North Runyan Drive
            some 575 feet southeast of the intersection of the
            northeast line of North Runyan Drive with the southeast
            line of Runyan Drive (if extended), thence northeast
            some 1167 feet, thence southeast some 32 feet, thence
            southwest some 1168 feet to the northeast line of North
            Runyan Drive, thence northwest some 32 feet with North
            Runyan Drive to the point of beginning.  Said street
            separates lots 6 and 11, from lots 7 and 10, Subdivision
            of the S. B. Godsey Farm, as shown by plat of record in
            deed book C, volume 18, page 556, ROHC, as shown in deed
            book J, volume 19, page 405, ROHC, and as shown in
            Chancery Court minute book O, volume 2, page 501 of Case
            No. 18060.  The second unnamed right-of-way begins on
            the southeast line of the first right-of-way some 532.5
            feet northeast of the intersection of the southeast line
            of said first right-of-way with the northeast line of
            North Runyan Drive, thence northeast some 485 feet,
            thence at a right angle northwest 30 feet, thence at a
            right angle southwest some 460 feet to the southeast
            line of the first unnamed right-of-way, thence southwest
            some 41 feet with said first right-of-way to the point

            of beginning.  Said second right-of-way appears only on
            the old Reeves tax map number 1880-C.  Tax Map No.
            117C-A-8.
           
           
       	    	 SECTION 2.  BE IT FURTHER ORDAINED, That this closure
       and abandonment is made subject to the following conditions:
            1.	 The Tennessee-American Water Company requests
                 reservation of an easement 20 feet in width for the
                 purpose of operating and maintaining their
                 facilities located within the right-of-way.
           
            2.	 The City of Chattanooga has a sewer located within
                 the right-of-way and reserves an easement for the
                 purpose of maintaining said sewer.
           
            3.	 All existing easements are retained.
           
           
       	    	 SECTION 3.  BE IT FURTHER ORDAINED, That this Ordinance
       shall be effective two (2) weeks from and after its passage as
       provided by law.
